Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Aviation Courseware online learning platform (“Platform”), operated by Aviation Courseware (“we”, “us”, or “our”), accessible at aviationcourseware.co.za and lms.aviationcourseware.co.za.

By registering for an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Eligibility

You must be at least 18 years of age or have the consent of a parent or legal guardian to use this Platform. By creating an account, you represent that the information you provide is accurate and complete.

3. Account Registration and Security

  • You must provide a valid email address and accurate personal information during registration.
  • You are required to enable Two-Factor Authentication (2FA) to access course content.
  • You are responsible for maintaining the confidentiality of your login credentials and authenticator device.
  • You must not share your account credentials with any other person.
  • Only one active session per account is permitted at any time.
  • We reserve the right to suspend or terminate accounts that show signs of credential sharing or unauthorised access.

4. Licence and Access

Upon valid purchase or activation code redemption, we grant you a personal, non-exclusive, non-transferable, revocable licence to access the specific software title(s) and e-book(s) associated with your entitlement.

  • Your licence is for personal educational use only.
  • You may not copy, reproduce, distribute, share, resell, sublicence, publicly display, or create derivative works from any content on the Platform.
  • Access to content requires a valid entitlement. Entitlements may be granted via activation code redemption (physical book purchase) or online purchase.
  • We reserve the right to revoke access for breach of these Terms.

5. Activation Codes

  • Physical books include a unique activation code that grants access to the related software and e-book on the Platform.
  • Each activation code may only be redeemed once and is linked to a single user account.
  • Activation codes cannot be transferred, resold, or reused once redeemed.
  • Lost or damaged codes may be subject to verification before replacement at our discretion.

6. Online Purchases

  • Software-only purchases made through our online store grant access to the purchased title and its associated e-book on the Platform.
  • All purchases are subject to the terms displayed at the point of sale.
  • Refund requests are handled in accordance with South African consumer protection legislation and our refund policy.

7. Prohibited Conduct

You agree not to:

  • Share, distribute, or transfer your account credentials to any other person.
  • Attempt to access content for which you do not hold a valid entitlement.
  • Use automated tools, bots, scrapers, or similar technologies to access or download Platform content.
  • Circumvent, disable, or interfere with security features, copy protection, or access controls on the Platform.
  • Record, screenshot, or otherwise capture protected content for redistribution.
  • Reverse-engineer, decompile, or disassemble any part of the Platform or its content.
  • Use the Platform for any unlawful purpose or in violation of any applicable laws.

8. Intellectual Property

All content on the Platform, including but not limited to software, animations, text, graphics, e-books, lesson materials, logos, trademarks, and user interface design, is the property of Aviation Courseware or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any ownership rights in any content on the Platform.

9. Disclaimer of Warranties

The Platform and all content are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

Aviation training content on this Platform is for educational and reference purposes only and does not replace formal flight instruction, approved training organisations, or official regulatory publications. See the in-app Disclaimer for full details.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Aviation Courseware shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of or inability to use the Platform.

11. Suspension and Termination

  • We may suspend or terminate your account at any time for breach of these Terms, suspected fraud, credential sharing, or any other reason at our sole discretion.
  • Upon termination, your access to all Platform content will be revoked immediately.
  • You may request account deletion by contacting us at info@aviationcourseware.co.za.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
